4. Definitions

Under the GDPR, “personal data” means any information relating to an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

6. Automated decision-making and profiling

Does the Data Controller apply automated decision-making or profiling? No.

7. Who may access your personal data?

As a general rule, the data subject’s personal data may be accessed by the Data Controller’s management and employees and by its contractual partners, to the extent necessary to perform their duties. For example, the employees and contractors involved in operating the dermaatelier.hu website may access the data subject’s personal data in order to operate the website and perform their contractual tasks.

Only in exceptional cases does the Data Controller transfer personal data to other state bodies. For example, where court proceedings are initiated in a dispute between the data subject and the Data Controller and the court requires documents containing personal data, or where the police contact the Data Controller and request the transfer of documents containing personal data for an investigation. In addition, the lawyer providing legal representation to the Data Controller may also access the personal data in the event of a dispute between the data subject and the Data Controller.

8. Data security measures

The Data Controller stores the personal data provided by the data subject in electronic form on the data servers it uses and, where necessary, in electronic form at its registered seat. For the processing of the data subject’s personal data, the Data Controller uses the service of the processor indicated under Recipients.

The Data Controller ensures, through appropriate information-security measures, that the personal data are protected against, among other things, unauthorised access and unauthorised alteration. For example, access to personal data stored on the servers is logged, so it can always be verified who accessed which personal data and when. Through appropriate organisational measures, the Data Controller ensures that personal data cannot become accessible to an indefinite number of persons.

9. Your rights

Right of access (Article 15 GDPR)

Under Article 15 GDPR, the data subject may request access to personal data concerning them as follows:

(1) The data subject has the right to obtain from the Data Controller confirmation as to whether personal data concerning them are being processed, and, where that is the case, access to the personal data and the following information:

  • b) the categories of personal data concerned;
  • c) the recipients or categories of recipient to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations;

  • e) the existence of the right to request from the Data Controller rectification or erasure of personal data or restriction of processing, and to object to such processing;
  • f) the right to lodge a complaint with a supervisory authority;
  • g) where the personal data are not collected from the data subject, any available information as to their source;
  • h) the existence of automated decision-making, including profiling, and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject.

(2) The Data Controller shall provide a copy of the personal data undergoing processing. For any further copies requested by the data subject, the Data Controller may charge a reasonable fee based on administrative costs. Where the data subject makes the request by electronic means, the information shall be provided in a commonly used electronic form, unless otherwise requested. The right to obtain a copy shall not adversely affect the rights and freedoms of others.

Right to rectification (Article 16 GDPR)

The data subject has the right to obtain from the Data Controller the rectification of inaccurate personal data concerning them. Taking into account the purposes of the processing, the data subject has the right to have incomplete personal data completed, including by means of providing a supplementary statement.

Right to erasure (Article 17 GDPR)

(1) The data subject has the right to obtain from the Data Controller the erasure of personal data concerning them, and the Data Controller must erase them without undue delay where one of the following grounds applies:

  • d) the personal data have been unlawfully processed;
  • e) the personal data have to be erased for compliance with a legal obligation in Union or Member State law (Hungarian law) to which the Data Controller is subject;
  • f) the personal data have been collected in relation to the offer of information society services.

(2) Where the Data Controller has made the personal data public and is obliged to erase them, the Data Controller, taking account of available technology and the cost of implementation, shall take reasonable steps, including technical measures, to inform controllers which are processing the personal data that the data subject has requested the erasure of any links to, or copy or replication of, those personal data.

(3) The data subject’s right to erasure may be restricted only where the exceptions set out in the GDPR apply, i.e. where further retention of the personal data is lawful, such as: (a) for exercising the right of freedom of expression and information, (b) for compliance with a legal obligation, (c) for the performance of a task carried out in the public interest, (d) for the exercise of official authority vested in the controller, (e) for reasons of public interest in the area of public health, (f) for archiving purposes in the public interest, (g) for scientific or historical research purposes or statistical purposes, or (h) for the establishment, exercise or defence of legal claims.

(1) The data subject has the right to obtain from the Data Controller restriction of processing where one of the following applies:

  • a) the accuracy of the personal data is contested by the data subject, for a period enabling the Data Controller to verify the accuracy;
  • b) the processing is unlawful and the data subject opposes the erasure and requests the restriction of their use instead;
  • c) the Data Controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defence of legal claims; or
  • d) the data subject has objected to processing pending the verification whether the legitimate grounds of the Data Controller override those of the data subject.

(2) Where processing has been restricted, such personal data shall, with the exception of storage, only be processed with the data subject’s consent or for the establishment, exercise or defence of legal claims, or for the protection of the rights of another natural or legal person, or for reasons of important public interest of the Union or of a Member State.

(3) The Data Controller shall inform the data subject before the restriction of processing is lifted.

Right to object (Article 21 GDPR)

(1) The data subject has the right to object, on grounds relating to their particular situation, at any time to processing of personal data concerning them based on public interest, the exercise of official authority or legitimate interests of the controller (or a third party), including profiling based on those provisions. The Data Controller shall no longer process the personal data unless it demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defence of legal claims.

(2) Where personal data are processed for direct marketing purposes, the data subject has the right to object at any time to processing of personal data concerning them for such marketing, which includes profiling to the extent that it is related to such direct marketing. Where the data subject objects, the personal data shall no longer be processed for such purposes.

(3) The right to object shall be explicitly brought to the data subject’s attention at the latest at the time of the first communication, and the related information shall be presented clearly and separately from any other information.

(2) In exercising the right to data portability, the data subject has the right to have the personal data transmitted directly from one controller to another, where technically feasible.

(3) The exercise of the right to data portability shall be without prejudice to the right to erasure. That right shall not apply to processing necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

(4) The right to data portability shall not adversely affect the rights and freedoms of others.

Right to withdraw consent (Article 7(3) GDPR)

The data subject has the right to withdraw their consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal. It shall be as easy to withdraw as to give consent.

10. Remedies and supervisory authority

Judicial remedies

In the event of unlawful processing experienced by the data subject, they may bring civil proceedings against the Data Controller. The case falls within the competence of the regional court (törvényszék). The action may also be brought, at the data subject’s choice, before the regional court of their place of residence.

Complaint to a supervisory authority

Without prejudice to any other administrative or judicial remedy, every data subject has the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, place of work or place of the alleged infringement, if the data subject considers that the processing of personal data relating to them infringes the GDPR.
